12. Temporary disability due to an accident - daily indemnity
By contracting this guarantee the insurer shall pay the insured, paid in arrears each month, the amount established in the policy's schedule, for each total day of leave, subject to the following rules:
- The maximum period of indemnity for this cover shall be 365 days, beginning from the date of the accident.
- The daily indemnity for temporary disability shall conclude when it has been declared that the insured suffers from permanent disability.
- In policies with a period of cover of less than one year, the maximum period of indemnity shall be limited to the number of days included in the insurance period.
- In cases where the insured performs manual labour the indemnity will be paid while the temporary disability prevents the person from performing his or her normal work.
- When the insured's line of work is not manual, or if he or she is unemployed, the daily amount will be paid while the temporary disability impedes the insured from leaving his or her residence, and will be reduced to half when the insured can begin to partially work or leave his or her residence.
- The reports regarding medical leave and discharge must be created by physicians determined by agreement between the insured and the insurer.
