5. Permanent disability due to accident
For the purposes of this cover permanent disability may be:
Total permanent disability, based on the definition from the preliminary article. Total disability shall also be applied when the insured, as a consequence of an accident covered by the insurance policy, sustains residual injuries that shall be indemnified with 100% of the sum insured for the permanent disability due to an accident cover, in accordance with the scale set forth in the general conditions to assess the degree of permanent disability.
Partial permanent disability, based on the definition from the preliminary article. Partial permanent disability shall be applied when the insured, as a consequence of an accident covered by the insurance policy, sustains residual injuries that shall be indemnified with less than 100% of the sum insured for the permanent disability due to an accident cover, in accordance with the scale set forth in the general conditions to assess the degree of permanent disability.
If the insured suffers from total or partial permanent disability as a direct consequence of an accident covered by the policy, which is declared within a two year term beginning from the date of the accident which took place while this insurance contract was in force, the insurer shall pay the indemnity corresponding to the degree of disability, in accordance with the percentages set forth in the scale established in these general conditions, applied to the sum insured established in the policy's schedule for permanent disability due to an accident.
The classification and degree of disability shall at all times be established in accordance with the scale which appears in this document, regardless of the insured's profession or any medical decision or judgement regarding the individual, as determined by a labour or criminal court.
